BOSTON- A Longmeadow physician has agreed to settle allegations of fraudulent billing.
According to U.S. Attorney Carmen Ortiz, Stanley J. Swierzewski III, M.D., has agreed to pay $300,000 to settle allegations under the False Claims Act.
Ortiz said, the agreement settles allegations that Dr. Swierzewski and his medical practice, Hampden Urological Associates of Holyoke and Westfield, improperly billed Medicare for services under the so-called “incident to” billing provisions of the Medicare program.
“Incident to” billing permits the services of a nurse practitioner or physician assistant to be billed as if they were performed by a licensed physician only when directly supervised by a physician.
Absent direct supervision, the Medicare reimbursement for nurse practitioners and physician assistants is only 85 percent of the physician’s rate, said Ortiz. The settlement resolves the government’s allegations that Dr. Swierzewski and his practice billed Medicare for services provided by physician assistants which did not meet these requirements.
